Civil Litigation

When you file a lawsuit or are served a summons, you need the counsel of an experienced attorney. We have represented plaintiffs and defendants in hundreds of lawsuits, and have tried cases before judges, juries, clerks, commissioners, and administrative law judges. We will work diligently to settle your case on terms that are acceptable to you. But we will also be prepared to try your case if necessary. Our litigation practice is focused on disputes involving estate and fiduciary matters, real estate, and timber.

We also handle appeals. The trial court’s primary function is to determine the facts of cases and apply legal principals to resolve disputes. But the role of appellate courts is to determine whether there was error at trial or in pretrial proceedings. In some cases, the fate of an appeal may be determined by the transcript and the record. But the outcome may also turn on the strength of legal arguments, an understanding of the applicable law, and effective writing. We regularly handle these cases.
